Terms of Service

Effective Date: January 16, 1992

By using our website or signing up for services with GigaWebX ("we," "us," "our"), you ("Client," "you") agree to the following Terms of Service. Please read them carefully.

1. Services Provided

GigaWebX provides non-ecommerce, service-based website design and hosting for small businesses.

  • The website build is provided at no upfront cost
  • The Client agrees to pay for monthly hosting services
  • We do not build e-commerce or online store websites

2. Minimum Contract Term (IMPORTANT)

By signing up for our services, the Client agrees to a minimum six (6) month hosting commitment.

  • The agreement begins on the date the website goes live or hosting begins, whichever occurs first
  • Early cancellation is not permitted during the initial 6-month term
  • This minimum term exists because the website build is provided at no upfront cost

3. Payments & Billing

  • A valid credit or debit card must be kept on file at all times
  • Hosting fees are billed monthly
  • By providing payment information, the Client authorizes GigaWebX to automatically charge the monthly hosting fee

Failed Payments

  • If a payment fails, the Client will be notified
  • Failure to resolve payment issues may result in temporary suspension or removal of the website
  • Continued non-payment may result in termination of services

4. Cancellations & Termination

During the 6-Month Term

  • Hosting may not be canceled during the minimum 6-month commitment
  • No refunds are provided for unused time

After the 12-Month Term

  • After the initial term, services may continue on a month-to-month basis
  • The Client may cancel with written notice prior to the next billing cycle

5. Website Ownership

  • The website remains hosted on GigaWebX servers during the active agreement
  • Website transfer or ownership rights are not guaranteed during the hosting term
  • Website files, layouts, and structure may not be copied, transferred, or resold without written permission

6. Client Responsibilities

The Client agrees to:

  • Provide accurate business information
  • Submit content (text, images, logos) they have legal rights to use
  • Respond in a timely manner during the build process

Client delays do not pause billing or extend the contract term.

7. Website Edits & Changes After Completion

Once the website build is completed and approved by the Client, any future changes, updates, or edits are not included in the free website build.

All post-completion edits are billed at $99 per edit request.

An "edit" includes, but is not limited to:

  • Text changes
  • Image replacements
  • Layout adjustments
  • Adding or removing sections
  • Content updates

Edits will not be made until payment is received.

Routine hosting, uptime, and basic maintenance are covered under the hosting fee. Content changes are not included unless otherwise agreed in writing.

8. Content & Legal Responsibility

  • The Client is solely responsible for the legality and accuracy of all website content
  • GigaWebX is not responsible for business results, compliance issues, or industry-specific regulations

9. No Guarantees

GigaWebX does not guarantee:

  • Search engine rankings
  • Lead volume, calls, or conversions
  • Business growth or revenue outcomes

Results vary by industry, market, and client involvement.

10. Service Limitations

  • Services are limited to non-ecommerce websites only
  • No shopping carts, checkout systems, or online payment processing are included
  • Hosting includes keeping the site live, secure, and accessible — not ongoing content updates unless otherwise agreed

11. Modifications to Terms or Services

We reserve the right to update or modify these Terms of Service at any time.

Material changes will be communicated when required.

12. Limitation of Liability

GigaWebX shall not be liable for:

  • Lost revenue or profits
  • Website downtime beyond reasonable control
  • Third-party service failures

Liability is limited to the amount paid for hosting services.

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the state in which GigaWebX operates.

14. Third-Party Services & Add-On Costs

Certain features, integrations, software, tools, or services requested by the Client may require the use of third-party providers or platforms, including but not limited to email marketing software, CRM systems, automation tools, premium plugins, domain registrations, SMS services, analytics tools, booking systems, or other external applications (collectively, "Third-Party Services").

The Client acknowledges and agrees that:

  • Any fees, subscriptions, licenses, or usage costs associated with Third-Party Services are the sole responsibility of the Client.
  • GigaWebX does not cover, advance, or absorb the cost of any Third-Party Services.
  • The Client must provide valid payment information directly to the third-party provider when required.
  • Continued functionality of any Third-Party Service depends on the Client maintaining active and current payments with the respective provider.
  • GigaWebX is not responsible for service interruptions, pricing changes, policy changes, feature removals, or performance issues caused by any Third-Party Service.
  • If integration assistance is requested, setup or configuration support may be billed separately unless otherwise agreed in writing.
